Terms of Service

CoterieTable is a platform operated by TrackBite LLC ("Company", "we", "us", or "our"). These Terms of Service govern your use of the CoterieTable platform and services provided by TrackBite LLC.

Legal Entity

CoterieTable is operated by TrackBite LLC, a limited liability company.

1. Agreement

These Terms of Service (“Terms”) govern your access to and use of the CoterieTable website, applications, and related services (collectively, the “Platform”). By creating an account, booking an experience, or otherwise using the Platform, you agree to these Terms and our Privacy Policy.

2. The marketplace

CoterieTable is an online marketplace that connects guests with independent culinary hosts. Hosts—not CoterieTable—design, promote, and operate their listed experiences. We provide technology for discovery, booking, communication tools as offered on the Platform, and payment processing in partnership with Stripe. We do not prepare, serve, or supervise meals at host venues.

3. Accounts

You must provide accurate information and keep your login credentials confidential. You are responsible for activity under your account. We may suspend or terminate accounts that violate these Terms, applicable law, or the safety or integrity of the community.

4. Bookings & payments

When you complete a paid booking, you authorize us and our payment partners to charge your selected payment method for the amounts shown at checkout, including applicable taxes and fees as displayed. Prices and availability are set by hosts subject to Platform controls. A booking is subject to the host’s stated experience details and the cancellation and refund rules presented at the time you book.

5. Cancellations & refunds

Cancellation, refund, and chargeback rules depend on the policy shown on the experience page and at checkout, applicable law, and the payment processor’s requirements. By booking, you acknowledge that policy as binding for that transaction.

6. Host responsibilities

Hosts are solely responsible for their experiences, including food safety, venue suitability, compliance with local regulations, insurance where appropriate, accurate listings, and courteous treatment of guests. By publishing or hosting through the Platform, hosts represent that they will meet these obligations and cooperate with reasonable verification or support requests from CoterieTable.

7. Waivers & disclosures

Dining and hospitality activities carry inherent risks. Where the Platform presents a participation waiver or dietary disclosure, you agree that providing accurate information and accepting any required waiver are conditions of attendance, to the extent permitted by law.

8. Content & intellectual property

You retain rights to content you submit; you grant TrackBite LLC a non-exclusive license to host, display, and distribute that content on the Platform for the purpose of operating and promoting the service. You may not scrape, reverse engineer, or misuse the Platform or other users’ content.

9. Disclaimers

The Platform is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability or fitness for a particular purpose, to the fullest extent permitted by law.

10. Limitation of liability

To the maximum extent permitted by law, TrackBite LLC and its directors, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, goodwill, or data, arising from your use of the Platform or any host experience. Our aggregate liability for claims arising out of these Terms or the Platform will not exceed the greater of (a) the fees TrackBite LLC earned from your bookings in the three months before the claim or (b) one hundred United States dollars (USD $100), except where liability cannot be limited by law.

11. Indemnity

You agree to defend and indemnify TrackBite LLC against claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Platform, your content, your experiences as a host, or your breach of these Terms, except to the extent caused by TrackBite LLC’s gross negligence or willful misconduct.

12. Changes

We may update these Terms from time to time. We will post the revised version on this page and update the “Last updated” date. Material changes may require additional acceptance flows on the Platform where required by law.

13. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law rules. Courts in Toronto, Ontario, have exclusive jurisdiction, subject to mandatory consumer protections in your place of residence where they cannot be waived.
